Fines and Penalties for Importers

The Trade Facilitation and Trade Enforcement Act of 2015 was signed by the President on February 24, 2016 and is heavy on “trade enforcement,” including collection of antidumping/countervailing duties, investigations of evasion allegations, protecting IPR, and enforcing child labor laws. This emphasis, successor liability, and the Trek Leather decision make an importer’s duty of exercising reasonable care more critical than ever.

Jon Yormick, Special Counsel – Customs & International Trade, Phillips Lytle LLP, will discuss the decision whether to make a prior disclosure, responding to U.S. Customs & Border Protection (CBP) and DHS/ICE investigations, and strategies for defending a CBP 592 penalty case.
